Welcome to Thresholdapp.com (the “Site”) operated by Threshold Software, Inc. (“Threshold,” “we,” “us,” or “our”). These Terms of Service (the “Terms”) govern your access to and use of our Site and services that enable you to upload photos and details of your home to share publicly (the “Service”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Eligibility & Accounts
- You must be at least 18 years old (or the age of majority where you live) to use the Service.
- You are responsible for the confidentiality of your account credentials and all activities under your account.
- Provide accurate, current, and complete information, and keep it updated.
2) User Content
You may upload photos, videos, text, and other materials about your home (“User Content”).
By uploading User Content, you represent and warrant that:
- You have the rights to share the content (you own it or have all necessary permissions from co owners, occupants, photographers, and other rightsholders).
- Public display: Content is public by default and may be viewed by anyone, indexed by search engines, embedded on third party sites, and shared on social media.
- No sensitive info: Do not include content that could compromise privacy or safety (e.g., precise addresses, GPS coordinates, entry points, alarm system details, floor plans, schedule patterns, access codes).
- Respect others’ rights: Do not upload third party IP without permission; do not include faces, license plates, or personal data of others without consent.
- Accuracy: Information provided must be accurate and not misleading.
3) License You Grant to Threshold
You retain ownership of your User Content. You grant Threshold a worldwide, non exclusive, royalty free, transferable, sublicensable license to host, store, reproduce, modify (e.g., resizing/cropping/compression), publish, publicly display, distribute, and otherwise use your User Content solely to operate, improve, promote, and provide the Service.
This license terminates when you remove your User Content from the Service, except that: (a) copies may persist in backups, caches, or archives; (b) we may retain copies as required by law or for legitimate business purposes; and (c) where your content has been shared or embedded by others, it may remain visible.
4) Our IP & License to You
The Service (including software, trademarks, logos, design, and look and feel) is owned by Threshold or its licensors and protected by law. We grant you a limited, non exclusive, non transferable, revocable license to use the Service as permitted by these Terms.
5) Prohibited Conduct
You agree not to:
- Post content that is illegal, infringing, defamatory, harassing, hateful, obscene, exploitative, violent, deceptive, or otherwise objectionable.
- Disclose private/sensitive information about yourself or others.
- Violate IP, privacy, or publicity rights.
- Upload malware or interfere with the Service’s operation; scrape at scale without permission.
- Impersonate others or misrepresent your relationship to a property.
- Use the Service for rentals, sales, or other commercial purposes unless we expressly allow it.
6) Moderation & Enforcement
We may, at our discretion and without notice:
- Review, remove, refuse, or restrict access to any User Content or accounts for policy violations, legal reasons, or safety.
- Suspend or terminate accounts for violations or to protect users and the Service.
- Report suspected illegal activity to authorities.
We are not obligated to monitor all content.
7) Reporting Infringement (Copyright / DMCA)

8) Privacy

9) Location, Safety & Sensitive Information
To protect your privacy and safety, avoid posting exact addresses, house numbers, floor plans, predictable schedules, or security details. If you include location identifiers (visually or in text), you do so at your own risk. We are not responsible for outcomes resulting from content you choose to make public.
10) Third Party Services
The Service may link to or integrate with third party sites/tools. We are not responsible for their content, policies, or practices. Your use of those services is governed by their terms and privacy policies.
11) Content Removal & Account Deletion
- Removing your content: You may delete your uploads (subject to technical limitations).
- Persistence: Deleted content may persist in backups, caches, or where others have saved/shared/embedded it.
- Account deletion: You may request account deletion; we may retain data as required by law, to enforce agreements, or resolve disputes.
12) Changes to the Service
We may modify, suspend, or discontinue all or part of the Service at any time without liability.
13) Disclaimers (No Warranty; Data May Disappear; Reference Only)
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRESHOLD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON INFRINGEMENT, ACCURACY OR COMPLETENESS, AVAILABILITY OR RELIABILITY, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
No Guarantee of Storage or Availability
User Content and data may disappear, be corrupted, or be deleted at any time, with or without notice. Threshold does not guarantee that any content will remain accessible, intact, or stored for any period.
Reference Only Content; No Reliance
Content on the Service is provided solely for general informational and reference purposes and must not be relied upon for safety, legal, financial, security, architectural, valuation, or real estate decisions. Threshold does not verify the accuracy, completeness, ownership, or truthfulness of User Content. Any reliance is at your own risk.
You acknowledge that publicly sharing images or information about your home carries inherent risks; you use the Service at your sole discretion and risk.
14) Limitation of Liability
To the maximum extent permitted by law, Threshold is not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of the Service, even if advised of the possibility.
Our total liability for any claim is limited to the greater of (a) the amounts you paid to Threshold in the 12 months preceding the claim or (b) $1. Some jurisdictions do not allow certain limitations; parts of this section may not apply to you.
15) Indemnification
You agree to defend, indemnify, and hold harmless Threshold, its affiliates, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of law or third party rights.
16) Communications; Marketing & Informational Messages
By creating an account or providing contact information, you agree that we may send you transactional, informational, and marketing communications via email and text/SMS (standard message and data rates may apply).
- You can opt out of marketing emails by using the unsubscribe link in the message.
- You can opt out of marketing SMS by replying STOP; for help, reply HELP.
- You will still receive essential transactional messages (e.g., security alerts, account notices) as permitted by law.
17) Governing Law & Venue
These Terms are governed by the laws of the Commonwealth of Virginia, excluding its conflict of law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Chesterfield, Virginia for disputes not subject to arbitration (if arbitration is adopted).
19) Changes to These Terms
We may update these Terms from time to time. Changes take effect upon posting with the “Last Updated” date. If we make material changes, we’ll provide reasonable notice (e.g., in product notice or email). Your continued use after changes constitutes acceptance.
